By registering an account, browsing the marketplace, listing products, or purchasing contact information on MagicMedia, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy.
If you are using the platform on behalf of a business entity, you represent that you have the authority to bind that entity to these terms.
Platform Description
MagicMedia is a multi-vendor digital marketplace that provides a platform for independent vendors to list and showcase their products and services. Buyers can browse listings and purchase contact information of vendors to connect directly.
Vendor Responsibilities
Vendors who list products on MagicMedia are solely responsible for:
- The accuracy, completeness, and truthfulness of all product information, including names, descriptions, specifications, pricing, and availability
- The quality, authenticity, and legality of the products and services they offer
- Ensuring that all images, videos, and media accurately represent the products being sold
- Compliance with all applicable local, state, national, and international laws, including export controls, trade regulations, and licensing requirements
- Maintaining valid and current contact information for buyers who purchase their contact details
- Responding to buyer inquiries and communications in a timely and professional manner
- Not listing prohibited, illegal, counterfeit, or misleading products or services
- All tax obligations arising from sales made through the platform
Buyer Responsibilities
Buyers who use MagicMedia acknowledge and agree that:
- They are purchasing contact information to connect with vendors, not purchasing products directly through the platform
- They must exercise their own due diligence before entering into any transaction with a vendor
- MagicMedia does not verify, guarantee, or endorse any vendor, product, or representation made on the platform
- They are responsible for evaluating the accuracy of product descriptions, images, and claims independently
- Any disputes regarding product quality, delivery, or authenticity must be resolved directly with the vendor
Images & Videos
MagicMedia is NOT responsible for any images or videos uploaded, displayed, or shared by vendors on the platform. This includes but is not limited to:
- The accuracy or authenticity of product images and videos
- Any mismatch between images/videos and the actual product delivered
- Images or videos that are misleading, deceptive, or digitally altered
- Any copyright infringement or unauthorized use of images/videos belonging to third parties
- The quality, resolution, or visual representation of any media content
- Any claims, damages, or losses arising from reliance on images or videos shown on the platform
Vendors are solely responsible for ensuring that all images and videos they upload are accurate, legally obtained, and do not infringe on any third-party rights. MagicMedia reserves the right to remove any media content that violates our guidelines, but has no obligation to verify or validate any media uploaded by vendors.
Product Descriptions
MagicMedia is NOT responsible for any product descriptions written or provided by vendors. This includes but is not limited to:
- The accuracy, completeness, or truthfulness of product descriptions
- Any exaggerated, false, or misleading claims made in product listings
- Specifications, dimensions, weight, material composition, or other product attributes stated in descriptions
- Any differences between the described product and the actual product received by the buyer
- Descriptions that violate advertising standards, consumer protection laws, or fair trade practices
- Any financial, physical, or consequential damages resulting from reliance on product descriptions
Buyers are strongly advised to independently verify all product details directly with the vendor before making any purchase decisions. MagicMedia does not review, validate, or certify any product descriptions before or after they are published on the platform.
Disputes & Liability
MagicMedia is NOT responsible for any disputes between buyers and vendors, or between vendors themselves. This includes but is not limited to:
- Disputes regarding product quality, condition, authenticity, or fitness for a particular purpose
- Disputes arising from misrepresented, counterfeit, or defective products
- Disputes related to delivery, shipping, timelines, or fulfillment of products
- Disputes over pricing, refunds, or payment issues between parties
- Disputes involving breach of contract, fraud, or misrepresentation by any vendor
- Any legal proceedings, claims, or arbitrations arising from transactions initiated through the platform
Limitation of Liability
To the maximum extent permitted by applicable law:
- MagicMedia shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the platform
- MagicMedia shall NOT be liable for any loss of profits, data, business opportunities, or goodwill
- MagicMedia's total liability shall not exceed the amount you paid to MagicMedia in the twelve (12) months preceding the claim
- MagicMedia does NOT guarantee uninterrupted, error-free, or secure operation of the platform
Indemnification
You agree to indemnify, defend, and hold harmless MagicMedia, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the platform in violation of these terms
- Your violation of any applicable law or regulation
- Any content you submit, post, or transmit through the platform
- Any dispute between you and another user of the platform
Payments & Refunds
- All payments on the platform are processed via USDT (TRC20) cryptocurrency or wallet credits
- Subscription fees (Basic, Pro, Enterprise) are non-refundable once the subscription is activated
- Contact information purchases are non-refundable once the contact details have been revealed to the buyer
- Extra product slot purchases are non-refundable once the slot has been added to the vendor's account
- MagicMedia is not liable for any transaction disputes between buyers and vendors regarding payments made directly between them outside the platform
- Vendors are responsible for their own refund and return policies, which must be communicated directly to buyers
Intellectual Property
The MagicMedia platform, including its design, logo, software, and original content, is the property of MagicMedia and is protected by intellectual property laws.
- Vendors retain ownership of their product content, images, and descriptions that they upload to the platform
- By listing products, vendors grant MagicMedia a non-exclusive, worldwide license to display, distribute, and promote their content on the platform
- MagicMedia implements image protection measures to prevent unauthorized downloading of vendor images by other platform users
- Any unauthorized use, reproduction, or distribution of content from the platform is strictly prohibited
- Vendors are responsible for ensuring their content does not infringe on any third-party intellectual property rights
Privacy & Data
We value your privacy. Our data practices are governed by our Privacy Policy. Key points:
- We collect and store personal information (name, email, phone) necessary for account creation and platform operation
- Vendor contact information is only shared with buyers who have purchased access through the platform
- We implement industry-standard security measures to protect your data
- We do not sell your personal data to third parties
- Phone numbers and email addresses are automatically stripped from product descriptions and enquiry messages to protect contact information
Modifications to Terms
MagicMedia reserves the right to modify, update, or replace these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting on the platform. Your continued use of the platform after any changes constitutes acceptance of the revised terms.

Governing Law & Contact
These Terms and Conditions are governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through appropriate legal channels.
